国家控烟条例有望年内出台北京室内公共场所拟

中国是世界上最大烟草生产国、消费国，吸烟人数高达3亿，每年因烟草相关疾病死亡人数超过一百万人。针对控烟，从即日起至4月30日，北京控烟条例草案公开征求民意。按照意见稿，今后有屋顶的室内场所将全面禁止吸烟。相比其他一些控烟立法的中国城市而言，“京版”控烟条例禁烟范围更大，执法主体也更加明确，被认为是中国地方控烟迈出的重要一步，同时也将对全国层面控烟立法起到推动作用。请听详细报道：

根据《北京市控制吸烟条例》草案意见稿的内容，今后室内公共空间将全面禁止吸烟，也就是所有屋顶的场所都全面禁烟。相对于此前，禁烟范围仅针对会议室等人员密集的公共场所，此次草案中的控烟的场所范围明显扩大。

这一草案也引起了不少市民的关注，记者采访时发现，无论是烟民还是非烟民，都对此表示赞成。

目前中国的公共场所禁烟的执行情况不容乐观，全国有十二个城市先后颁布控烟地方法规，但不少城市多年未有一例处罚，可以说，执行不力是公共场所控烟的难点所在。此次北京新公布的控烟条例草案明确了执法的主体和惩罚的力度。中国控制吸烟协会办公室主任曾繁玉介绍说，北京借鉴香港经验，规定卫生行政部门一家执法，相比一些城市的多头管理，效果会更好。

“北京现在明确卫生行政部门是全面负责执法的。跟香港，澳门地区等控烟搞得比较好的(地区) 是一致的。我们的香港特区是卫生部门执法，其它部门配合，有一个部门(负责) 而不是多头执法。(相对而言) 上海是多头执法，多头执法基本上包括很多部门，卫生、交通，工商，公安，各干各的，这样做谁也不管，谁也管不了。”

北京的控烟条例草案规定在禁止吸烟场所吸烟的，处以50元罚款; 拒不改正的，处以200元罚款。相比现行条例对吸烟处罚10元的规定，

草案征求稿提高了罚则。但在曾繁玉看来，惩罚的力度仍稍显不足：

“我觉得香港的禁烟经验和深圳值得借鉴，香港过去就是规定1500到5000块港币可以罚，结果是很不好处理，最后就规定1500块，只要你在公共场所吸烟，不管你是第一次还是第二次，只要发现，就罚你1500块港币。而现在在深圳就是罚200块钱。而在北京罚50块引不起关注，他无所谓。”

在地方加强管控的同时，有无国家级控烟法律也是控烟能否成功的关键所在。目前世界上已经有50多个国家有无烟环境的立法，而在中国，目前公共场所禁烟仍停留在地方法律和行政法规层面。而目前地方立法的不断推进，正倒逼国家层面的控烟立法加速进行。

国家卫生计生委新闻发言人透露，室内公共场所禁止吸烟条例已列入国务院立法计划，控烟立法有望在不久的将来取得突破：

“关于控烟的立法，在我国有不同的层级。从去年开始，关于室内公共场所禁止吸烟条例的起草工作已经启动，而且列入了国务院的立法计划。现在国家卫生计生委要争取在2014年出台禁止室内公共场所吸烟的条例，同时我们也在积极争取通过全国人大立法控制烟草危害。”
