(一) 诉讼与管辖

离婚诉讼由一方当事人提起。案件管辖的一般原则是原告就被告”，即原则上应由被告住所地人民法院管辖。被告离开住所地超过1年的，由原告住所地人民法院管辖; 双方离开住所地超过1年的，由被告经常居住地人民法院管辖，没有经常居住地的，由原告起诉时居住地人民法院管辖; 双方都是军人的，一般应由被告住所地或被告所在部队团以上机关所在地人民法院管辖; 双方当事人都被监禁或被劳动教养的，一般由被告原住所地的人民法院管辖，被告被监禁或被劳动教养满1年以上的，由被告被监禁地或被劳动教养地的人民法院管辖。

上述地域管辖是离婚案件管辖的一般原则，特殊情况下，按照《民事诉讼法》及有关司法解释的规定，可由原告住所地或经常居住地人民法院管辖; 对不在中华人民共和国领域内居住的人、下落不明或者宣告失踪的人以及被劳动教养或者被监禁的人提起的离婚诉讼，由原告住所地或者经常居住地人民法院辖。

(二) 调解

调解是人民法院审理离婚案件的必经程序，由于其发生在诉讼过程中，所以也叫诉讼内调解。

在诉讼过程中进行调解，有利于对当事人进行法制宣传教育和思想指导工作，妥善、慎重地处理离婚案件。而且对调解所达成的协议，当事人一般愿意执行，这不仅有效预防了纠纷的进一步恶化，也减少了法院的执行工作。

人民法院在调解时必须坚持自愿、合法的原则。同时在查清事实的基础上进行，要分清双方的是非责任。必要时可与当地的基层组织、有关单位密切合作，共同进行说服教育工作，以促进当事人互谅互让，促成和好或达成离婚协议。

调解有三种结果：第一，调解后双方当事人和好，原告撤诉，诉讼结束; 第二，双方当事人达成离婚协议，人民法院按协议制作离婚调解书，调解书送达后，即发生法律效力，婚姻关系自此解除; 第三，调解无效，应立即进入下一诉讼程序。

(三) 审理与判决

人民法院审理离婚案件，当事人除不能表达意志的以外，都应出庭。确因特殊情况无法出庭的，必须向人民法院提交书面意见; 由于离婚案
